Skype affiliate can keep Skyp.com

Benjamin Decraene from Belgium is the owner of the domain name skyp.com, and uses the domain name to redirect visitors to skype.com. WIPO denied skype.com complaint. The WIPO expert took into account the fact that the respondent is an affiliate of the complainant:

“After reviewing all of the proof provided by the Complainant and the Respondent, the Panel finds it established that the Respondent has been allowed – on several occasions – to insert a hyperlink on his website to the Complainant’s website within the scope of different affiliation programs. The fact that an announcer expressly accepts – as in this case – that an affiliate becomes part of an affiliation program hyperlinking to the announcer’s website may, according to this Panel, be considered as an authorization/permission to use the Domain Name. The Complainant, by accepting the Respondent as an affiliate, could perhaps be regarded as having recognized the rights and/or legitimate interests of the Respondent in the Domain Name.”

Tucows launches domain name auction

“The secondary market for domains represents a new source of revenue for Tucows and our channel of service providers,” said Elliot Noss, President and CEO Tucows Inc. “Our strategy is to create a suite of services specifically designed to harness the reach of our channel and give service providers the information and tools they need to take advantage of this growing business.”

Domain Name Auction is a white-labeled service. Service providers can offer potential new registrants the ability to bid on expiring domains via links from the service provider’s website. The first auctions are expected to begin February 13, 2006. Buyers of domain names will be able to find out information on how to participate in the auctions at www.tucowsauctions.com. Registrants maintain their right to renew and keep their domain throughout the auction process. Tucows’ Parked Pages service will generate revenue from pay-per-click advertising for both expired and unexpired domain names. This revenue will be shared with service providers.

Tucows’ Domain Name Auction and Parked Pages services are being offered in beta to existing members of the company’s service provider channel. During the beta period, service providers are being asked to provide feedback on the business policies and tools associated with the services.”

Irish government plans to regulate .IE

“The Irish Department of Communications is planning to put in place a regulatory framework for the IE domain. This is a good and bad - bad because regulation may well impose an administrative and cost burden, but good because it will spur reform of the Registry (a private company, with self-selected directors) which is unwilling to reform itself from within.”
